the negative inference from not calling your ‘best’ witness is good enough. All McNair had to do was show Lloyd was available but not called by the NCAA. Also dangerous to call him because unless you get the judge to declare him a hostile witness you will have him on direct and that will give the NCAA the advantage of getting him on cross-examination where they get to lead him (basically the NCAA attorney would be testifying through leading questions). It was better for McNair not to call him.
