It's a trust that will be subject to title 9. But I think this can be good for USC since you can lure athletes with a promise of pay thru the trust, and then promote NIL for the bigger recruits. And USC should really have the best NIL in the country, eventually, given its location and multiple existing partnerships with Hollywood. So it can be a sturdy bridge to get them on campus.

I don't think they are going to be able to put the toothpaste back in the tube. Should have been proactive decades ago with sharing the proceeds, bc now you can fully expect a legal challenge here.
I think soon the big ten and or sec will form their own football organization outside the ncaa. Would not surprise me if at some point we enter a period where there are two national Championships. And kids go back and forth between whether your in one or the other. Similar to all the belts and organizations in boxing or ufc.
And then we will enter a period where people argue over which champ is better. People will call for them to play. And then the money will be too great not to. And on and on. I've probably spelled out a time frame long past when we are all dead

the only confusion between the two is when boosters are paying for play and claiming NIL
without an email chain, personal testimony, or a written contract how could the NCAA ever prove the difference?
